By booking with Banff Bear Travel Inc., you acknowledge and agree to these Terms and Conditions. Please read them carefully before proceeding with your booking.
Booking Process
- Tour availability displayed on the Website is subject to change without notice. Banff Bear Travel Inc. reserves the right to modify or cancel tours due to unforeseen circumstances or insufficient bookings. A confirmation email will be sent upon successful booking.
- Please ensure all information provided is accurate. Banff Bear Travel Inc. is not responsible for errors or omissions made during the booking process.
- All travellers are responsible for ensuring that they possess a valid tourist visa and travel documents required to visit your selected destination.
Payment Methods
- All prices are displayed in Canadian Dollars (CAD).
- Payments can be made using the payment methods specified during the booking process.
- Prices are subject to change without notice. The price at the time of booking will be honored unless otherwise specified.
- Prices include applicable taxes and fees if explicitly stated in the product description.
- Banff Bear Travel Inc. uses secure payment processing systems, but Banff Bear Travel Inc. is not liable for unauthorized access or loss of personal or financial information.
Traveler Responsibilities
- Travellers must arrive at the designated meeting point on time.
- Ensure proper documentation, including tickets, identification, or permits, is brought to the tour.
- Travellers are responsible for their personal belongings and safety during the tour.
- Comply with all rules, regulations, and instructions provided by Banff Bear Travel Inc. staff and guides.
- Customers must be physically and mentally fit for their chosen tour and follow all safety instructions provided.
- Guests under 18 must be accompanied by their parents or legal guardian.
- Photo ID may be required for identity verification.
Bus Rules
- Arrive pickup point on time. Latecomers may be responsible for all the loss caused to the company or other customers onboard.
- Seat belts must be fastened while the vehicle is in motion.
- No standing or walking in the vehicle while it is moving.
- No Food and drinks on the bus. Only bottled water is allowed.
- No smoking on the bus or immediately before embarking.
- All passengers must respect fellow travelers, guides, and drivers.
- Any form of harassment, violence, verbal abuse, or physical altercation is strictly prohibited. Violators will be reported to the police immediately, removed from the tour without a refund, and held liable for any damages caused.
- Passengers causing any damage to the vehicle or equipment will be held financially responsible for repair or replacement costs.
- No pets are on our tours or private transfer services. Exceptions are made for trained service animals with appropriate accreditation and only with advanced notice. Emotional support animals will not be accepted.
- A strict no-illegal substance policy applies to all tours.
- Failure to adhere to these rules may result in removal from the tour without refund. Banff Bear Travel Inc. reserves the right to take appropriate actions to ensure the safety and comfort of all passengers.
Timeliness
- Customers must arrive at the pickup point on time. Latecomers will be accommodated for up to 5 minutes. Beyond this time, no refunds will be provided.
- If you have a connecting flight, suggested departure time after 10:30 pm.
Changes to Bookings
- Requests for changes to bookings must be submitted at least 24 hours before the tour, and are subject to availability and approval by Banff Bear Travel Inc.. Additional fees may apply for modifications. Each booking is allowed one change only. If your change is approved, we will send you an updated confirmation letter.
- Banff Bear Travel Inc. may adjust itineraries due to force majeure events (e.g., weather, road closures, traffic accidents etc). Customers will be notified of significant changes and given options to accept, select an alternative, or receive a full refund. Banff Bear Travel Inc. will endeavour to operate the tour as indicated.
Cancellations and Refunds
- No-show Policy: No refunds will be issued for no-shows, regardless of the reason.
- Right to Cancel: Banff Bear Travel Inc. reserves the right to cancel any tour or service at its discretion. In such cases, customers will be offered an alternative tour or full refund.
- Acts of God: Tours may be canceled without prior notice due to unforeseen circumstances (e.g., weather, natural disasters). Refunds (excluding incurred non-refundable expenses) or rescheduling will be addressed on a case-by-case basis.
- Tours without non-refundable ticket-Based Activities:
- We offer a worry-free 24-hour cancellation policy, unless otherwise stated on your confirmation document.
- Simply contact us at least 24 hours prior to your tour to cancel or reschedule and receive a full refund—no questions asked.
- Applicable only to tours that do not include non-refundable tickets (e.g., Gondolas, Icefield Adventure, etc.).
- Tours with non-refundable ticketed experiences:
- Cancellation within 5 days of the tour date will result in a 40% refund (i.e., 60% cancellation fee)
- This fee only covers the cost of non-refundable tickets—we do not profit from any cancelled tours.
- No additional charges to transfer your spot to a friend or family member.
- Please contact us at least 24 hours before the tour, and we will gladly update the participant information free for you.
Liability
- Banff Bear Travel Inc. is not liable for personal injury, loss, or damage to personal belongings during the tour. Banff Bear Travel Inc. is not responsible for delays, interruptions, or cancellations caused by factors beyond its control.
- Assumption of Risk: Participation in our tours involves inherent risks. By booking, customers acknowledge and accept these risks.
- Limitation of Liability: Banff Bear Travel Inc. and its employees, agents, and affiliates are not liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to personal injury, property damage, or loss of enjoyment caused by factors outside our control, including weather, wildlife encounters, or customer negligence. In case of accidents leading to injuries or other losses during the trip, resolutions will be based on the regulations set by airlines, hotels, buses, restaurants, sightseeing facilities, and other operating entities. Banff Bear Travel Inc. bears no responsibility in such circumstances.
- Personal Belongings: Customers are responsible for safeguarding their personal belongings. Banff Bear Travel Inc. are not liable for lost or stolen items resulting from negligence in leaving items unattended.
- Force Majeure: Banff Bear Travel Inc. are not liable for failure or delay in performance due to events beyond our control, including but not limited to natural disasters, strikes, or transportation disruptions, acts of God, war, terrorism, or labor disputes.
Compliance with Laws and rules
- You must comply with all applicable laws and regulations of the jurisdictions as well as rules set by airlines, hotels, buses, restaurants, sightseeing facilities, and other operating entities visited during the tour.
Intellectual Property
- All content on Banff Bear Travel Inc.’s online booking platform, including text, graphics, logos, and images, is the property of Banff Bear Travel Inc. and protected by copyright and trademark laws. Unauthorized use of any content is strictly prohibited.
Privacy Policy
- Personal information collected during booking is used solely for operational purposes.
- Banff Bear Travel Inc. complies with Alberta’s Personal Information Protection Act (PIPA) to ensure data security.
Governing Law and Jurisdiction
- These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Alberta, Canada. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Calgary, Alberta.
Severability
- If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Amendments
- Banff Bear Travel Inc. reserves the right to amend these Terms and Conditions without prior notice. Updates will be posted on our Website, and continued use implies your acceptance of the revised terms. Unless otherwise stated in the product detail, these policies apply to all products sold on this site.
- In case of discrepancies, the English version of the terms and conditions shall prevail.
